ELIGIBILITY: The Free Electricity For A Year Sweepstakes (the “Sweepstakes”) is open to those who at time of entry are 21 or older and are legal residents of following “eligible states”: Delaware, Illinois, Maine, Massachusetts,  New Hampshire, New Jersey, Ohio, Pennsylvania, Rhode Island, and the District of Columbia. Officers, directors, employees and agents of SmartEnergy Holdings, LLC (the “Sponsor”), as well as any members of their immediate families (spouse, parent, sibling and child) and persons living in the same household, and the respective parent companies, affiliates, subsidiaries, marketing and promotional partners, retailers, vendors and advertising and promotional agencies of Sponsor are ineligible to enter. Void outside the eligible states listed herein and where prohibited by law.

SWEEPSTAKES ENTRY PERIODS: Sweepstakes begins at 12:00:00 AM Eastern Time (“ET”) on February 5, 2024 and ends at 11:59:59 PM ET on January 31, 2025 (the “Sweepstakes Entry Period”). Sweepstakes Entry Period consists of twelve (12) Monthly Entry Periods. The Monthly Entry Periods are as follows:

HOW TO ENTER: Entry Method #1 (Toll-Free Number): Call the toll-free number listed on the offer you received and follow all instructions to speak with a customer representative during a given Monthly Sweepstakes Entry Period. During the call, each entrant will need to provide his/her Prize ID # located in the offer  received via mail. If you enroll for SmartEnergy, your name and Prize ID # will be entered into the monthly random drawing(s) for which it qualifies and automatically into subsequent monthly random drawings, if any. The Sponsor and/or its designated agent(s) reserves the right to reject any Prize ID # deemed ineligible in their sole discretion. In the event more than one Prize ID # is received from any one home address, the first Prize ID # processed will be considered the only valid Entry received. If you do not enroll for SmartEnergy, your name and Prize ID # will  be entered into the monthly random drawing(s) for which it qualifies. Regardless of enrollment status, there is a limit of one (1) Toll-Free entry per Prize ID #. To enter subsequent monthly random drawings,  you will need to enter by mail (e.g., Entry Method #2). Entry Method #2 (“Mail-in Entry”):  On a postcard, hand print your name, Prize ID #, address, e-mail address and telephone number and insert it into a #10 envelope. Affix proper postage on the envelope and address it to:  Free Electricity For A Year Sweepstakes Entries, P.O. Bix 9331, Medford, NY 11763-9331. Your Mail-in Entry must be postmarked during a given Monthly Entry Period and received seven (7) days thereafter. Limit:  one (1) Mail-in Entry per home address per Monthly Entry Period. In the event more than one (1) Mail-in Entry is received from any one home address, the first Mail-in Entry processed. No mechanical reproduction permitted. Sponsor is not liable for lost, late, illegible, incomplete, misdirected, postage due mail, or corrupted Entries whether due to a technical error or otherwise. Entries become the property of Sponsor and will not be acknowledged or returned.

To qualify for a given Monthly Entry Period prize, your telephone entry must be received during a given Monthly Entry Period. Mail-in entries must be postmarked during a given Monthly Entry Period and received seven (7) days thereafter.

If during any Monthly Entry Period, no eligible entries are received for its respective monthly drawing, that monthly  prize will be awarded as an additional prize in the following monthly drawing provided a sufficient number of entries are received for that Monthly Entry Period. If no entries are received for the last Monthly Entry Period, then the final monthly prize will be awarded from among all eligible entries received during the Sweepstakes Entry Period.

PRIZES: A total of twelve (12) winners (i.e., one (1) winner per monthly random drawing) will be selected at random. Each winner will receive up to $1,500.00 towards the winner’s annual electricity expenses. All prizes will be awarded as a corporate check. Limit: one prize per home address. Total value of all prizes: $18,000.00.

WINNER SELECTION & NOTIFICATION: Each Monthly Entry Period’s random drawing will be conducted within approximately seven (7) days after the conclusion of each given Monthly Entry Period. All random drawings will be conducted under supervision of an independent judging organization (“judges”) whose decisions are final. Each potential winner will be notified by email and/or US mail. Winners will be required to complete, sign and return Affidavit of Eligibility/Release of Liability and Publicity documents(s) which must be signed, notarized and returned within seven (7) business days of date printed on notification or winner will be disqualified. Prizes awarded within approximately thirty (30) days after winner verification. If a potential winner cannot be contacted, or a prize notification is returned as undeliverable or if a selected winner cannot accept or receive the prize for any reason, or if the winner is not in compliance with these Official Rules, the corresponding prize will be forfeited and awarded to an alternate winner in a separate random drawing.  At Sponsor’s discretion, if after five (5) attempts a potential monthly winner is not confirmed for a given Monthly Entry Period, the corresponding prize may not be awarded. Prizes are non-assignable and non-transferable except to a surviving spouse. Winners are responsible for any federal, state and local taxes. Winners will be required to provide their Social Security number before the awarding of any prize to comply with IRS tax reporting requirements. The Sponsor will file an IRS Form 1099 with the Internal Revenue Service if the retail value of the prize is $600.00 or greater. If a winner refuses to provide his/her Social Security number for a prize worth $600.00 or greater, the winner will be disqualified and an alternate winner will be selected in accordance with these Official Rules. Any other incidental expenses on prize not specified herein are the sole responsibility of each winner. Except where prohibited by law, entry and acceptance of prize constitute permission to use each winner’s name, prize won, hometown, likeness, video tape, photographs, and statements for purposes of advertising, promotion and publicity (including online posting) in any and all media now or hereafter known throughout the world in perpetuity, without additional compensation, notification or permission.

ODDS OF WINNING: Odds of winning depend on the number of eligible entries received per drawing, estimated to range between 1:1,500 to 1:15,000.

RELEASE: Participating entrants agree to these Official Rules and the decisions of the judges and the Sponsor, and release the Sponsor, its respective parent, subsidiaries, affiliates, advertising and promotion agencies, and any other individual or company involved in the development or execution of the Sweepstakes as well as the employees, officers, directors, agents and shareholders of each, from all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons (including death) and property which may be sustained in connection with either directly or indirectly, 1) the awarding, receipt, ownership, use or misuse of a prize awarded herein; or 2) participation in the Sweepstakes. Sponsor is not responsible if Sweepstakes cannot take place or if any prize cannot be awarded due to cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the prizes.

GENERAL: By participating in the Sweepstakes, you: (i) agree to be bound by these Official Rules, including all eligibility requirements; and (ii) agree to be bound by the decisions of Sponsor and judges, which are final and binding in all matters relating to the Sweepstakes. Sponsor reserves the right in its sole discretion to permanently disqualify any person it believes has intentionally violated these Official Rules.

In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the “Authorized Account Holder” of the telephone number submitted at time of entry. Authorized Account Holder means the natural person who is assigned to telephone number by a telephone number provide or other organization(s) that is responsible for assigning telephone numbers. Entry materials/data, including Prize ID #s that have been tampered with or altered, or mass entries, or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction, or unauthorized access to, or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems, or (ii) any injury or damage to entrant’s or any other person’s telephone related to or resulting from participating in the Sweepstakes. Sponsor reserves the right in its sole discretion to cancel the Sweepstakes if it becomes technically corrupted such that, in Sponsor’s sole determination, the method of entry cannot be conducted as originally planned and to select winner(s) from among all eligible entries received prior to withdrawal. Legal Warning: ANY ATTEMPT BY AN individual, whether or not an ENTRANT, TO DELIBERATELY DAMAGE, destroy, tamper OR interfere with the OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS and THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES and diligently pursue all remedies against ANY SUCH individual TO THE FULLEST EXTENT PERMITTED BY LAW.
